CallsYou Terms of Service
Effective from August 24, 2026
This document sets out the rules for using CallsYou — the callback widget, the panel and related tools available at callsyou.com. We tried to keep it plain and readable: no hidden asterisks, just like our pricing.
§1Who provides the service
The CallsYou service (the "Service") is provided by:
Referred to below as the "Provider" or "we".
§2Definitions
- Customer — a business that has entered into an agreement with us to use the Service and embeds the Widget on its website;
- Widget — a script placed on the Customer's website that lets a Visitor request a callback ("we'll call you back in 30 seconds") or leave a number for later;
- Visitor — a person browsing the Customer's website who uses the Widget;
- Panel — the application available at callsyou.com/app where the Customer and its agents answer calls and manage the widget, history and billing; the agent mobile app is part of the Panel;
- Plan — the selected paid tier (e.g. Starter, Pro) with its Minute Pool;
- Minute Pool — the number of billing units available in a given period; one minute of a call answered in the browser uses 1 unit, one minute answered on a mobile phone uses 2 units;
- Price List — the current prices of Plans and packs published at callsyou.com (the "Pricing" section).
§3What the Service includes
- the Widget for embedding on the Customer's website, with customizable look, texts, language and business hours;
- automatic connection of phone calls between the Visitor and the Customer's team — via the browser (WebRTC) or to the team's mobile numbers, depending on the selected mode;
- the Panel with call history, notes, statistics and agent account management;
- collecting requests (leads) outside business hours or after the Minute Pool runs out;
- additional features marked in the Panel or Price List as belonging to a given Plan (e.g. call recording in the Pro plan).
The Service is aimed at businesses (B2B). To use it you need: a website where the script can be embedded, an up-to-date browser and — for browser calls — a microphone and a stable internet connection.
§4Agreement and account
Accounts are created by us after you get in touch (the "Book a consultation" button on the home page, or e-mail). The agreement is concluded when the Customer receives login credentials to the Panel and runs for an indefinite period, billed monthly or yearly according to the selected Plan.
The Customer agrees to provide true company details and keep them up to date. Login credentials are confidential; the Customer is responsible for the actions of anyone it grants access to (including agent accounts) as for its own.
§5Pricing, Minute Pool and packs
Current Plan prices are listed in the Price List on the home page. In short:
- each Plan includes a monthly Minute Pool (e.g. Starter — 50, Pro — 100 units) that resets at the start of each billing period and does not carry over;
- a call answered in the browser uses 1 unit per minute; a call answered on a mobile phone uses 2 units per minute (such calls cost us twice as much with the carrier);
- additional one-time minute packs go into a "wallet": they never expire, they add up, and they are consumed only after the Plan minutes run out;
- when the Pool runs out, the Widget keeps working — it collects numbers as leads, and the Customer can buy a pack or upgrade; a call in progress may be automatically ended when the limit is reached.
Prices in the Price List are net prices; applicable tax (VAT) is added to each payment and an invoice is issued automatically.
§6Payments and trial
Payments are handled by Stripe — by payment card, as a recurring subscription for Plans and as one-time payments for minute packs. The Customer can manage the subscription and card details at any time in the billing portal available from the Panel.
If we offer a trial, the following applies: it lasts 3 days and includes 3 Pool minutes, it requires a payment card and is available once per Customer. After the trial ends the subscription becomes paid unless cancelled earlier.
Price List changes are not retroactive: they do not affect a period already paid for, and existing subscriptions keep their current price until the Customer changes the Plan. In case of overdue payments we may — after an unsuccessful reminder — limit or suspend the Service until the balance is settled.
§7Customer obligations
- not to use the Service for unsolicited calls (voice spam, telemarketing without a legal basis), harassment or any activity infringing third-party rights;
- to fulfil its own information duties towards Visitors under the GDPR and other laws (the Widget initiates a call only at the Visitor's request);
- not to interfere with the Service, probe its security without our consent, or generate artificial traffic (e.g. automated requests);
- to embed the Widget only on websites it is entitled to use.
In case of a serious breach we may suspend the Service with immediate effect, informing the Customer of the reason; in other cases we will first request that the breach be remedied within a reasonable time.
§8Availability and liability
We do our best to keep the Service running without interruption, but — like any telecom solution — it also depends on third parties: telecom carriers, infrastructure providers and the payment operator. We do not guarantee that every call will connect (e.g. when the Visitor's number is unreachable or a carrier network fails).
- we give advance notice of planned maintenance that may cause downtime, in the Panel or by e-mail;
- our total liability towards the Customer is limited to the fees paid by the Customer in the 12 months preceding the event giving rise to the claim;
- we are not liable for lost profits or indirect damage, unless caused intentionally;
- the limitations in this section do not apply where mandatory law does not allow liability to be limited.
§9Personal data
How we process personal data — of both the Customer and Visitors — is described in our Privacy Policy. To the extent we process Visitors' data (e.g. phone numbers) to handle requests from the Customer's widget, we enter into a data processing agreement at the Customer's request.
§10Complaints
Complaints about the Service can be submitted by e-mail to admin@callsyou.com. Please describe the issue and, if it concerns a specific call, its approximate date and time. We handle complaints within 14 days of receipt and reply by e-mail.
§11Termination
The Customer may resign from the Service at any time — by cancelling the subscription in the Panel (billing portal) or by e-mail. Resignation takes effect at the end of the paid billing period; we do not refund fees for a period already started, unless mandatory law provides otherwise. Unused minutes from one-time packs remain available until the agreement ends.
We may terminate the agreement with 30 days' notice (e.g. when discontinuing the Service), or with immediate effect in the cases described in §7.
§12Changes to these Terms
We may amend these Terms for valid reasons: changes in law, changes to the scope or manner of providing the Service, or security reasons. We will announce changes in the Panel or by e-mail at least 14 days before they take effect. A Customer who does not accept the changes may terminate the agreement before that date — the previous version applies until the end of the current period.
§13Final provisions
Matters not covered here are governed by Polish law. Disputes with business Customers are resolved by the court competent for the Provider's seat. If any provision of these Terms proves invalid, the remaining provisions stay in force.
